The website www.single.earth and its subdomains (“Website”) are operated by Single.Earth OÜ, a company established and existing under the laws of the Republic of Estonia with the registry code 14873080 and registered address at Volta 1, Tallinn 10412, Estonia. Single.Earth operates under the virtual asset service provider licence issued by the Estonian Financial Intelligence Unit (licence no. FVT000524).

Our overall goal is to build a system of technical, scientific and financial means which would facilitate conservation of the natural environment to maintain and improve the provision of ecosystem services (namely carbon sequestration in biomass) and ecosystem integrity (function, structure and composition of ecosystems, i.e., biodiversity) globally. 

The Website is not intended for use or directed to any person in any jurisdiction (including the US) where (by reason of that person´s nationality, residence or otherwise) the publication or availability of the Website or the services is or may be prohibited.

The use of the Website is governed by these Website Terms of Use (“Terms”). In addition to the provisions of these Terms, our Privacy Policy and other relevant agreements depending on the service we may provide to you, shall apply.

We take your privacy very seriously and are committed to protecting personal information and confidentiality of our users, and being transparent about how we process information about our users. We will manage all and any personal information that we collect through the Website and the information you submit to us when setting up a Single.Earth account and using our services in accordance with our Privacy Policy.

The content on our Website, unless being part of our services regulated by our Single.Earth General Terms of Service or other relevant document for specific services, is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our Website, we make no representations, warranties or guarantees, whether express or implied, that the content on our Website is accurate, complete or up-to-date.

Where our Website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources. We shall not be responsible in any way for the content of such other websites. We provide such links only as a convenience.

Single.Earth account

You are able to sign up for a Single.Earth account on our Website to use the basic functionality of our platform by providing your name and a valid email address (“Account”). 

By registering for a Single.Earth Account, you confirm that:
(i) you are at least 18 years old and have full legal capacity and are entitled to enter a valid agreement with us under the laws of the country of your residence;  
(ii) you have read, understood, and agree to be bound by these Terms and our Privacy Policy, including any future modifications.
(iii)  you have created a strong password that you do not use for any other website or online service; 

Registering for the Account and verifying your email will give you basic access to our Single.Earth platform but does not automatically create a client relationship between you and us. In order to access our services as a client, you are obliged to go through a client verification process. We will only open user accounts and offer services for persons who have successfully completed the onboarding process and who have accepted our General Terms of Service and other relevant agreements if applicable. For more information about our user account opening process, please see our General Terms of Service available on our Website.  

In case you do not accept the General Terms of Service or if you are not onboarded we will not be able to offer you any services but you will still have the access to your Account without any further functionality. 

If you wish to delete your Account and all information it contains you can use the “delete account” button on the platform (if available) or reach out to us at support@single.earth and we are happy to assist. Please note that we might not be able to delete all information obtained from your Account as we are obliged under the laws to retain some information due to applicable regulations (e.g., regulations on anti-money laundering). In case you have also opened a user account with us, the termination of the Account will take place in accordance with the General Terms of Service. When you have any questions about how we process and retain your personal information, please refer to our Privacy Policy or send us an email to support@single.earth. 

You are responsible for maintaining the confidentiality of your Account details and you are fully responsible for all activities that occur under your Account. Your Account must be used only by you and must not be shared with, or transferred to any other individual.

We reserve the right to suspend or terminate your Account if we, acting reasonably, suspect that any information you provide in your account is untrue, inaccurate or does not comply with our Terms.

Changes to the Website and these terms

The information made available on our Website may be altered or removed at any time without prior notice.

These Terms and the Privacy Policy may be amended at any time and the new revision will take effect immediately. If we make changes to these Terms we will post an updated version on our Website. 

You should revisit these Terms on a regular basis as revised versions will be binding on you. Your continued use of the Website following the posting of such updated version constitutes your acceptance of any changes to these Terms.

All information available on our Website including content of a graphic nature, are the property of Single.Earth, unless the content is marked or generally acknowledged to be the property of a third party.

Unless otherwise indicated in the relevant content, and on the condition that you comply with all of your obligations under these Terms, you are authorized to view, copy, print, and distribute (but not modify) the content on this Website; provided that (i) such use is for informational, noncommercial purposes only, and (ii) any copy of the content that you make must include the copyright notice or a reference to the original content.

You will comply with all applicable laws in accessing and using this Website. By logging onto the Single.Earth platform shall not be deemed as Single.Earth transferring any intellectual property to you. 

“Single.Earth”, “MERIT”, the Single.Earth and tree logo are trademarks or registered trademarks of Single.Earth (collectively “Single.Earth Mark”). Except as expressly provided in these Terms of Use or as expressly authorized in writing by the relevant trademark owner, you shall not use any Single.Earth Mark either alone or in combination with other words or design elements, including in any press release, advertisement, or other promotional or marketing material or media, whether in written, oral, electronic, visual or any other form.

References to other parties’ trademarks on this Website are for identification purposes only and do not indicate that such parties have approved this Website or any of its contents. These Terms of Use do not grant you any right to use the trademarks of other parties.

Interruptions to Website usage

To ensure the best possible service level, we reserve the right to interrupt the usage of the Website for maintenance, system updates or any other changes. 

Additionally, the Website might not be available due to reasons outside our reasonable control, such as “force majeure”.

Single.Earth does not assume any liability for damages or losses resulting from visiting the Website Single.Earth, including the use of information made available on this Website. 

Single.Earth’s responsibility for information connected to Single.Earth’s own services is additionally limited by the separate agreements of the appropriate service, made available to the user when signing up with a specific service and published on our Website.

Governing Law / Jurisdiction

If any provision of these Terms is held to be invalid, void due to contradicting law or for any reason unenforceable, such provisions shall be struck out and shall not affect the validity and enforceability of the remaining provisions.

As each country has laws that may differ from those of Estonia, by accessing our Website, you agree that the statutes and laws of Estonia, without regard to the conflict of laws and will apply to all matters relating to the use of the Website. 

Furthermore, any action to enforce these Terms shall be brought to Harju County Court in Tallinn, Estonia. You hereby agree to the jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

If any provision of these Terms is held to be invalid, void due to contradicting law or for any reason unenforceable, such provisions shall be struck out and shall not affect the validity and enforceability of the remaining provisions.

Language

These Terms were originally written in English. To the extent any translated version of these Terms conflicts with the English version, the English version prevails.
